1. Limitation of Liability
To the maximum extent permitted by applicable law:
- Hudukey provides the Platform on an "as is" and "as available" basis. We do not warrant that the Platform will be error-free, uninterrupted, or free of harmful components.
- Hudukey is a technology platform that facilitates route planning and community connections. We are not a transport operator and do not organise, supervise, or insure any ride. Participation in any ride is entirely at your own risk.
- In no event shall Hudukey, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, personal injury, or property damage — whether based in contract, tort (including negligence), strict liability, or otherwise.
- Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to Hudukey in the 3 months preceding the event giving rise to the claim, or INR 1,000, whichever is greater.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence or fraud.
2. Ride Risk Acknowledgement
Motorcycle touring and group riding involve inherent risks, including but not limited to road accidents, adverse weather, mechanical failure, physical injury, and death. By using the Hudukey Platform to plan, join, or organise a ride, you acknowledge and accept the following:
- You voluntarily assume all risks associated with motorcycle riding, including those arising from your own actions, the actions of other road users, and conditions beyond any party's control.
- Hudukey is a technology platform. We provide route planning tools, community features, and information resources. We do not supervise rides, verify the roadworthiness of vehicles, assess the fitness of riders, or guarantee the accuracy of route data provided by VYOM or other features.
- Route information generated by VYOM is provided for convenience only. Actual road conditions, legal restrictions, and safety considerations may differ. You are responsible for independently verifying route suitability before commencing a ride.
- You confirm that you hold a valid driving licence, that your vehicle is roadworthy and appropriately insured, and that you are physically and mentally fit to undertake the planned ride.
- You agree to ride within the speed limits prescribed under the Motor Vehicles Act, 1988, and applicable state transport regulations, and to wear a helmet and appropriate protective gear at all times.
